This End-User Agreement (“Agreement”) is entered into between you (“User” or “You”) and EcoAct Group (“EcoAct,” “We,” or “Us”), governing your use of the EcoAct ACTR Tool (“ACTR Tool”) accessible at https://actr-tool.eco-act.com/.
By using the ACTR Tool, you agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree with these terms, please do not use the ACTR Tool.
1. Purpose of the ACTR Tool: The EcoAct ACTR Tool is a questionnaire designed to assess an organization’s sustainability maturity. While it is particularly beneficial for Corporate Social Responsibility (CSR) teams, it is open for use by anyone interested in evaluating sustainability practices within an organization.
2. Data Handling and GDPR Disclaimer: By using the ACTR Tool, you acknowledge and agree that the data you provide herein will be stored and processed by EcoAct for commercial purposes. We are committed to safeguarding your privacy and handling your data in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR). 3. License to Use: EcoAct grants you a non-exclusive, non-transferable, revocable license to use the ACTR Tool for its intended purpose, in accordance with the terms of this Agreement.
4. Prohibited Conduct: You agree not to engage in any conduct that may impair the functionality, security, or integrity of the ACTR Tool. Prohibited conduct includes, but is not limited to, attempting to gain unauthorized access, interfering with the proper functioning of the ACTR Tool, or using the ACTR Tool for any unlawful purpose.
5. Intellectual Property: The ACTR Tool and all associated content, features, and functionality are owned by EcoAct and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6. Modifications and Updates: EcoAct reserves the right to modify, update, or discontinue the ACTR Tool or any part thereof at any time without prior notice. By continuing to use the ACTR Tool after such modifications or updates, you agree to be bound by the revised terms.
7. Limitation of Liability: To the fullest extent permitted by applicable law, EcoAct shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the ACTR Tool.
8. Governing Law: This Agreement is governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

10. Acceptance: By continuing to use the EcoAct ACTR Tool, you signify your acceptance of this Agreement and any future revisions. If you do not agree with the terms of this Agreement, please discontinue use of the ACTR Tool.
